With the buyer tax credit opportunity upon us, it is probably a good time to share with you some of the idiosyncrasies related to it. My data is based on the NAR updates I receive on a regular basis and I hope you will find this helpful for your personal use or will pass it along to someone you know who could benefit from the information.
Basically, to receive the tax benefit, the home owner can only use it for “moving up” if he has occupied the same principal residence for 5 out of the last 8 years consecutively. This may be a strong consideration for someone getting ready to retire and move to a new area.
Additionally, the buyer has the right to choose which tax year is preferable for filing to claim the credit – either 2009 or 2010. If the buyer chooses to file in 2009, forget filing electronically. IRS hasn’t put the forms on line and will take 3 or 4 months to send the refund. It would be wise to plan accordingly.
While a mobile home or travel trailer that is affixed to land qualifies, don’t consider using your new RV for the credit. If it is possible to use it for your next vacation, it will not be IRS approved.
Another area that IRS will be watching is a transfer of title between family members in an attempt to receive the credit. All transfers between close relatives including parents, children, grandparents and grandchildren are definitely not permissible under the regulations.
A person who has no income and therefore pays no tax is also ineligible. For example, a student without earnings cannot qualify for the credit. However, one would also hope that he could not qualify for the mortgage from either a lender or a seller - but strange things do happen!
